The consequences for vaping in Australia are becoming increasingly severe. In the Australian Capital Territory (ACT), the use, sale, and supply of vaping products containing nicotine is strictly regulated. This is due to the fact that nicotine is a highly addictive substance and can be harmful to human health.
Vaping, also known as the use of electronic cigarettes (e-cigarettes) and e-liquid, has gained popularity in Australia. However, it is important to note that the sale and supply of vaping products containing nicotine is illegal in the ACT without proper authorisation. This is largely because nicotine is classified as a poison in Australia, with the potential to cause addiction and other health-related issues.
Those found to be in breach of these laws can face serious consequences. According to section 26 of the Medicines, Poisons and Therapeutic Goods Act 2008 (ACT), the maximum penalty for supplying vaping products containing nicotine without authorisation is an $80,000 fine and/or up to 5 years imprisonment. This law aims to protect public health by ensuring that nicotine products are only available through regulated channels.
The Australian Government is also taking measures to ensure that vaping products are not accessible to minors. As of 22 June 2022, it is illegal to sell or supply vaping products to anyone under the age of 18 in the ACT. This aligns with broader efforts to prevent young people from starting to vape, given the potential health risks associated with nicotine addiction.
It is clear that the consequences for vaping in Australia are becoming increasingly severe. Vapers and retailers alike must be aware of the legal landscape surrounding the sale and supply of vaping products containing nicotine. In the ACT, it is illegal to sell or supply these products without authorisation, and those found in breach can face serious penalties.
Additionally, as of 22 June 2022, selling or supplying vaping products to individuals under the age of 18 is strictly prohibited.
